Summary

All images appearing on the pictivity.com web site and distributed from Pictivity are subject to copyright. No images are within the Public Domain. Any use of images outside of the guidelines outlined in this document is copyright infringement.

When purchasing images please be clear about the licence of use you have purchased.

Pictivity operates with the following licensing policies:

PRIVATE USE, limited to: (a) personal, non-commercial or (b) sample, design, test, or layout use ("comp use").
PUBLIC USE (diffusion by any means), for non-commercial purpose by individuals and volunteer organizations will likely be granted free permission, but written approval is required. Free permissions always require proper attribution (including an active backlink, if used on the web), and no alterations.
COMMERCIAL USE includes all profit making organizations and publishing houses, both in print and on the web, and any other use not contained in the above usage types.

A. Image uses that require a commercial license

Sold, or used in any way in connection with any activity where payment is earned. This includes, but is not limited to:

use on behalf of any organization which has paid personnel (INCLUDING NON-PROFIT, educational, religious, or government),
use in your professional work (for example internal presentations, newsletters, logo, stationary, cards, preaching materials, and teaching materials),
use for advertising, editorial or promotional purposes (including any fund raising activities and auctions),
use on a commercial, advertising or promotional web site,
use on a product that is sold, or contains paid advertising.

The only exception is sample, design, test, or layout use ("comp use"), for the purpose of evaluating how a finished piece would look. Very few commercial licenses are granted solely in exchange for credits or links.

B. Image uses that don't require a commercial license

1. PRIVATE USE for personal, non-commercial purpose : requires permission

Personal (and only personal) non-commercial, private use includes:

Screen saver or background image on your computer or in your digital photo frame,
Printing a few images from your home printer or at your local photo shop ("Boots", etc), limited to a maximum print size of 15" x 10".
Emailing a copy to a family member or friend - except for participants in the same event where they themselves have a direct interest in the images. They will need to acquire their own license. Rights granted to you are not transferable.

Please note that this is for private use only. All other usage, including the distribution or reproduction of multiple copies, public display or otherwise use in a public way of the images require written authorization. Please enquire if in doubt.

2. PUBLIC USE (diffusion) for personal, non-commercial purpose : requires permission

Permission will most likely be granted for free for the following types of reproduction:

Making derivative works such as paintings and drawing for personal or educational use,
Limited diffusion in personal educational documents such as school reports and thesis (for student only).
Displaying on a non-commercial web page (or commercial web page if licence was granted on a TFCD basis) provided that you display the appropriate attribute next to the image. See the section General Conditions for details.

However, you do need to email me for authorization with full image numbers of the image(s) you wish to use, the details of your project, and/or the address of your finished web page. Please be sure to read the section General Conditions below.

3. PUBLIC USE (diffusion) for all-volunteer organizations : requires permission

Please pay note that "all-volunteer" and "non-profit" are NOT the same. If you are an all-volunteer organization with no paid staff or membership fee, and you provide only free services or information, you will likely qualify to use free image fors:

The organization's brochure, newsletter, other mass printed materials or slide/Power Point presentation,
displaying on the organization's web page, provided that you display the appropriate attribute next to the image. See the section General Conditions below.

All-volunteer organization image use require written authorization and apply only for the dissemination of information. Free use will NOT be granted for fund raising activities, nor for ANY organization that has paid personnel, or charges for services or membership. For consideration, email me with the following information: (a) Name, full address and background of the organization, (b) Intended usage for the image(s), (c) Address of the non-profit web site (if any). (d) State explicitly that nobody in your organization is paid (merely stating that they are not paid for the task for which image(s) are required is insufficient). Please be sure to read the section General Conditions below.

C. General conditions for image use

Attribution. If image attribution is required by the license, the rendered size of the font used must match the size of the surrounding text, and must be easily readable against its background and within its surroundings. All free images must carry appropriate copyright information next to the images or text, e.g.: "Images by pictivity.com, all rights reserved.".

The following is considered appropriate HTML code:

If, and only if, it is not possible to place a hyperlink alongside the image, the image must appear with a suitably visible watermark or border containing the copyright imprint such as appears on the pictivity.com website. Such imprinted images can be supplied upon request.

No Alterations. All free images and those requiring accreditation must accurately represent the original work and be used in their entirety. Tampering, additions, excessive cropping, low quality reproduction, or other alterations and transformations that would affect the integrity of the image are not permitted. This includes removal of any watermark or border containing copyright information.

Rights. No usage rights granted are transferable without explicit written permission. In case of PUBLIC USE, any grant of rights is only for the specific use for which you were granted permission. Any other subsequent use requires a separate authorization. You own the medium on which image files are recorded, but all image files remain the property of pictivity.com and may only be used according to the usage rights licensed to you.

D. General terms of use of this website

Prohibited actions

Embedding images into a web page, that is have a direct ("hot") link (img src) to any image (jpeg file).
Using programs to automatically download or spider large portions of the pictivity.com site for other purposes than indexing.
Framing or iframing of any of the pictivity.com web pages or content.
